According to state law, single-family homeowners can build an ADU on their property as long as there is space for it. The state law dictates that any ADU be 10 ft from the main residence and 5 feet from the property lines. However, local communities can determine these size and setback. So you will have to check your local restrictions to ensure you have the space.

What Is Considered An ADU?

ADUs do not have to be detached, they can be built on as part of an extension. They can also be established in existing structures like garages, pool houses, or outbuildings. However, not every structure can qualify as an ADU. ADUs are required by law to have their own entrance, kitchen, and bathroom. Also, campers, RVs, and trailers do not qualify as ADUs. There are also size limitations on the square footage of the ADU by county.

Do I Need A Permit for My ADU?

Yes, you will need the relevant permits for your ADU. Each community will be different, so check with your local government’s office. If you are building an ADU, you will also need to have a full inspection as you would with any residential property. In Los Angeles, you’ll also be required to get a certificate of occupancy before anyone can move into the space.
